1. Definition of Terms

• 1.1.1. "Site Administration" – authorized employees to manage the site Emerald RP, who organize and/or process personal data, as well as determine the purposes and means of processing personal data.
• 1.1.2. "Personal Data" – any information relating to an identified or identifiable natural person (the subject of personal data).
• 1.1.3. • 1.1.4. "Confidentiality of personal data" – a mandatory requirement for the Operator or other person who has access to personal data not to allow their dissemination without the consent of the personal data subject or other legal basis.
• 1.1.5. "Website Emerald RP" – a set of interconnected web pages on the Internet at en.gta5emeraldrp.online and its subdomains.
• 1.1.6. "Subdomains" – pages or a set of pages located on third-level domains belonging to Emerald RP, as well as other temporary pages with contact information of the Administration.
• 1.1.7. "Website user Emerald RP" – a person accessing the Emerald RP site via the Internet and using its information, materials, and products.
• 1.1.8. "Cookies" – a small piece of data sent by a web server and stored on the user's computer, sent by the web client or web browser to the web server each time an HTTP request is made to open a page of the corresponding site.
• 1.1.9. "IP address" – a unique network address of a node in a computer network through which the User gains access to Emerald RP.

2. General Provisions

1. Use of the Emerald RP website by the User means consent to this Privacy Policy and the terms of processing the User's personal data.
2. If the User disagrees with the terms of the Privacy Policy, they must stop using the Emerald RP website.
3. This Privacy Policy applies only to the Emerald RP website. Emerald RP is not responsible for third-party websites that the User can access via links available on the Emerald RP website.
4. The Administration does not verify the accuracy of personal data provided by the User.

3. Subject of the Privacy Policy

1. This Privacy Policy sets forth the Administration's obligations to non-disclosure and ensure the protection of the privacy of personal data provided by the User upon request of the Administration upon registration or subscription to the Emerald RP website.
2. Personal data permitted to be processed under this Privacy Policy are provided by the User by filling out forms on the Emerald RP website and may include:

   • Contact phone number
   • Email address
   • Place of residence (if necessary)
   • Photo (if necessary)
3. Emerald RP also protects data that is automatically transmitted when visiting pages:

   • Browser information

4. Any other personal information not specified above must be stored securely and not distributed, except as provided in this Policy.

4. Purposes of Collecting User Personal Information

5. Methods and Terms of Processing Personal Information

5. The Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of personal data.

6. Rights and Obligations of the Parties

6.1. The User has the right:

• To make a free decision to provide their personal data required to use the Emerald RP website, and give consent to their processing.
• To update, supplement the provided information about personal data in the event of a change in this information.
• To receive from the Administration information concerning the processing of their personal data, unless otherwise limited by law. The User has the right to demand clarification, blocking, or destruction of personal data if it is incomplete, outdated, inaccurate, illegally obtained, or unnecessary for the stated purposes of processing, and to take measures provided by law to protect their rights. To do this, notify the Administration by the specified email address.

6.2. The Administration is obliged:

• To use the information received solely for the purposes specified in this Privacy Policy.
• To ensure that confidential information is kept confidential and not disclosed without the prior written permission of the User, except as provided in this Policy.
• To take precautions to protect the privacy of the User's personal data in accordance with the usual procedure for protecting such information in business practice.
• To block personal data related to the relevant User from the moment of the request or appeal for the period of verification, in case of detection of inaccurate personal data or illegal actions.

7. Responsibility of the Parties

1. The User acknowledges and agrees that the Administration is not responsible for any direct or indirect losses, lost profits, data loss, damage to honor, dignity, or business reputation, or any other damages resulting from the use or inability to use the Service, including technical failures, data deletion, loss of access, and other circumstances.
2. The User agrees that they use the Service at their own risk, and all services are provided "as is" without any warranties from the Administration.
3. The Administration is not responsible for the security of personal data, loss, or disclosure of information if it occurs due to reasons beyond its control, including but not limited to: actions of third parties, virus attacks, equipment or software failures, user errors.
4. The User is fully responsible for complying with all applicable laws, including but not limited to copyright and related rights, trademarks, advertising, and data protection laws, concerning any content published or transmitted by them through the Service.
5. The Administration does not control or verify the information posted by Users, and is not responsible for its accuracy, legality, or compliance with moral or other standards.
6. The User acknowledges that they are fully responsible for any consequences of their actions on the website, including but not limited to: posting content, interacting with other Users, using the features of the Service.
7. The Administration reserves the right to remove any information that violates the terms of this Policy without prior notice and to restrict or terminate the User's access to the Service without explanation.
8. All risks associated with the use of the Service are entirely borne by the User. The Administration does not guarantee the error-free and uninterrupted operation of the Service, data security, compatibility with the User's devices, or that it will meet their expectations.

8. Dispute Resolution

1. Before submitting any claim or initiating legal proceedings, the parties agree to resolve all disputes, disagreements, or demands related to the use of the Service through a pre-trial (complaint) procedure by sending a written or electronic notice with a proposal for voluntary settlement.
2. The Administration shall review the received complaint and respond within 30 (thirty) calendar days from the date of receipt. The Administration's response shall be considered final and not subject to appeal unless otherwise explicitly stated in the internal rules of the Service.
3. If no resolution is reached through the complaint procedure, the Administration shall make a final decision based on an internal assessment of the situation. The User agrees that the Administration's decision is final, binding, and not subject to further review.
4. This Policy and all relations between the User and the Administration are governed exclusively by the internal regulations of the project. The application of national or international law is excluded if it conflicts with the provisions of this Policy or the interests of the Administration.

9. Additional Terms

1. The Administration reserves the right to make changes to this Privacy Policy without the User's consent.
2. The new version of the Privacy Policy comes into effect from the moment it is published on the Emerald RP website, unless otherwise specified in the new version of the Policy.

10. Acceptance of Services and Refund Policy

1. Account top-ups within the Service are made by the User voluntarily, on a non-refundable basis, as an unconditional donation to support the development of the gaming project. Such top-ups do not constitute payment for any services under applicable civil law.
2. From the moment funds are credited to the User's account in the Service, no refunds shall be issued under any circumstances, including but not limited to: refusal to use the Service, account deletion, account suspension or banning, technical malfunctions, or changes in the project's operation or terms.
3. By topping up their account, the User confirms that they fully understand and unconditionally accept these terms and expressly waive any monetary claims or demands against the Administration of the project.
4. Topping up an account does not grant the User any proprietary or non-proprietary rights regarding the Service or its functionality and is considered solely as voluntary support of the project.
5. These provisions take precedence over any other terms published on the website or communicated elsewhere and are deemed final and non-negotiable.
